As reported in the Norwich Bulletin:

Broken bench at Lisbon Walmart nets woman $654K

New London, Conn. —A jury in New London on Friday awarded a 53-year-old woman $654,000 in damages for injuries sustained when a dressing room bench broke at the Walmart in Lisbon, according to Hartford Attorney Frank J. McCoy.

Lori Shriver had filed the suit after she was injured in a July 17, 2006, incident at the Walmart. McCoy said that due to a defect in the bench, Shriver fell and suffered lacerations, a broken tooth, shoulder injuries and an exacerbation of a back injury, which required surgery.

The trial, which started on April 13, lasted four days. McCoy said that, with interest, the judgment could near $1 million.

McCoy said Shriver was relieved that it was over and she was vindicated by the judgment.
“It is the responsibility of businesses to take all reasonable measures to ensure that the premises are safe,” McCoy said.

Congratulations to our Connecticut Accident Attorney Frank McCoy

On April 13, 2012, a New London jury sent a clear message to Walmart executives: Take responsibility!

For six years Walmart had refused to accept responsibility for injuries caused by the unsafe conditions in their Lisbon, Connecticut store.

On July 17, 2006, the plaintiff, a 52 year old woman was injured at a Lisbon, Connecticut Wal Mart due to a defective condition in the store. She was caused to injure her shoulder and exacerbate a pre-existing back condition ultimately requiring surgery. She’s endured excruciating pain in the six years since, undergone pain management techniques, and surgery. Wal Mart denied responsibility in the case.

The woman was represented by Attorney Frank McCoy of McCoy & McCoy in Hartford, Connecticut. On April 13, 2012, A New London, Connecticut jury awarded the woman 657,000. With interest, the verdict may approach one million dollars.

Walmart had an obvious duty of care to maintain the safety of its store for its patrons. In premises liability cases, all too often it’s about timing and best efforts. In this situation Walmart employess admitted they had never inspected the safety conditions of the area our client was injured. As a result, she suffered needlessly.

Attorney Frank McCoy has over 20 years of experience in personal injury, medical malpractice, and product liability litigation. Attorney McCoy is a Nationally Board Certified Civil Trial Lawyer, a member of the Connecticut Bar Association, and a member of the Connecticut Trial Lawyers Association. Mr. McCoy bases his practice in Hartford Connectiut. as the President and owner of McCoy & McCoy, LLC., Law Firm.

According to the Valenties day edition of the Hartford Courant, Kyle Berry of Enfield fled the scene of the fatal two car accident he was involved in.

Two East Windsor car accident victims were killed, and two others were seriously injured when two cars collided on Route 191 and one veered off the road, crashed into a tree, and rolled over, police said.

The other vehicle involved, was a pickup truck driven by Berry. He initially fled the scene. A resident who saw the truck called police Tuesday.

The two vehicles were southbound on Route 191, also known as Broad Brook Road, when the Connecticut auto accident occurred around 1 a.m. The Nissan went off the road, into a tree and rolled over, police said.
The pickup continued south, then turned around in a driveway and fled northbound, police said. It sustained damage to the passenger side and the front end.

Deputy Fire Chief PaulJanuszewski said the portion of Route 191 where the crash happened is notorious for serious crashes. "We have had a number of fatals on this stretch of roadway," Januszewski said. "This is a well-known stretch for fatal or serious accidents."

3 Car Accident Secrets the insurance Companies Don't Want You To Know

I've spent many years studying what works and what doesn't in the field of personal injury, and I've discovered there are a few things that the big Insurance giants out there wouldn't want you to know!

Here are 3 Car Accident Secrets that the Insurance Comapnies Don't Want You To Know:

SECRET #1: YOU MUST TAKE IMMEDIATE ACTION TO PRESERVE YOUR RIGHTS.

One of the most important times in your Connecticut personal injury case is immediately following your accident. This is the time when evidence is available and details are fresh in the minds of all parties involved. There are a number of important steps that must be taken immediately. Evidence must be preserved. If you have had an accident in a retail store, near a gas station, or any place that has video cameras running, those tapes must be secured. If a faulty object has caused you injuries, the object must be preserved and not discarded. Your Connecticut accident lawyer will put the party on notice that they are to keep this evidence in a safe place for inspection or later use. Photographs should also be obtained. Taking a picture at the scene of your accident is extremely helpful, as are pictures of any evidence including cars involved if it was a car accident, or the area you were in if it was a premises case. Witnesses need to be contacted. People move, change phone numbers, and most of all forget details!! Contacting a witness immediately following your Connecticut accident will ensure their input is part of your case. The longer you wait the greater chance the evidence will be lost.

SECRET #2: The Insurance Companies are Not Your Friends

They are a business, and in order to keep their doors open, they need to make money. Time and time again we hear clients say how nice the adjuster was in the beginning of their case. The next part of that statement is "but at the end of my treatment they told me they would not pay for my medical bills." Again, this is because they are not your friend and are in business to make money. The less money they give you for your accident, the more money they make. In the eyes of the insurance companies – it is not about making friends, it is about staying in business.

SECRET #3: The Insurance Company May Use A Computer Program To Determine the Value of Your Injury Claim.

In an effort to maximize their profits and minimize how much they pay you, most insurance companies now use computer programs to analyze your bodily injury claim. Adjuster turnover rates are high, and each adjuster comes to a file with varying degrees of knowledge about bodily injuries. Using a systematic computer program allows each adjuster to input data and receive a calculated value. This value is your settlement. The program does not take in to account that you are a human being with emotions, relationships, hobbies, etc… All of the areas effected by you injury are left out of this equation. According to Computer Science Corporation, 13 of the top 20 largest auto insurers now use Colossus. One shocking aspect of Colossus is that it has been implemented very effectively to substantially reduce payments for bodily injuries.

These are just three of the many secrets insurance companies dont want you to know about. There are many more, and they all hurt your Connecticut personal injury case, if you are not using a Connecticut personal injury lawyer.

Ask any Connecticut parent if they remember the day their child rode the school bus for the very first time, and you will hear story after story as this memory is forever etched indelibly in their hearts. Watching your child "who was just born yesterday" wave goodbye from his seat and be driven off by a person one hardly knows, is an experience that is hard to forget! Putting your child in the hands of a stranger is not easy. Most parents don't know anything about the bus driver, or his/her background.

Under Connecticut law, school bus drivers must have the appropriate license and endorsements to qualify as a Connecticut school bus driver. This can be obtained by walking in to any full service DMV and taking the 30 question written test in which 24 questions need to be answered correct. No appointment is needed. Bus driver candidates are also subject to a background check, fingerprinting and drug testing.

Unfortunately, even with these requirements, innocent Connecticut children are seriously injured or killed due to involvement in school bus accidents. When school bus companies and drivers do not place the children's safety first, and act in a negligent manner, they endanger the lives of the children and place them at risk for being injured.

In addition, when a school bus driver is negligent, they also place other motor vehicle drivers and pedestrians lives at risk too.

Over the past two weeks the words "Car accident" have appeared in the local CT headlines over a dozen times!! We learned about car vs. car accidents, tractor trailer vs. car accident, car vs. house accident, and car vs. pedestrian accidents!! Why is this happening? In Connecticut we have enjoyed very mild winter driving conditions. Accidents caused by snow, sleet, and ice are nothing compared to last winter!!

So what or who is to blame for the continuing number of Connecticut car crashes? Certainly our driving laws are being enforced. Streets and highways are patrolled 24/7 by Connecticut Sate and local police. Speeding limits are closely monitored through the use of radar guns. Local police make sure that we are safe by enforcing and issuing fines for not wearing seatbelts. Tickets are being written for distracted driving. What is left? Some think that the new teenage driving laws are to blame. The teen laws prohibiting car pooling have resulted in an enormous increase of young drivers on the road at any given time - but mostly commuter traffic times! The empty HOV lanes are proof of that even though the highway is filled with cars. Drive by any Connecticut high school between 7:00-7:30am and you will see long lines of vehicles all driving to the same destination with only the driver present. With all of these young drivers on the road at the same time you would think they are to blame for the continued number of connecticuit car crashes. However, read the recent headlines regarding Connecticut car accidents and you won't find any young drivers mentioned. These recent accidents have all involved drivers in their late 20's and older. So if we cant blame law enforcement, and we cant blame young drivers, we must review our own driving behavior and make sure we continue to drive with caution, always watching out for "the other guy " who might drive through a stop light or sign. We should be aware of how close we follow another car, providing enough distance incase the car ahead stops suddenly or slams on the brakes. After decades of listening to victims of car accidents I can only warn that you can never be too careful!!

On this snowy winter day, please drive safe!

Driving down the highway is not the time to multitask! In our technology driven fast paced world multitasking is considered the norm. Calling in a PeaPod order on the way to work, answering emails, scheduling doctors appointments are all tasks that if we can do them in the car, there will be one less thing to think about later in our day. While it may not seem like a bad driving habit to check email, talk on our handsfree phone, or listen to loud music, these and other distractions can cause a driver to swerve into another lane, rear-end a slower vehicle, drive off the road, or make other serious and potentially fatal mistakes.

Two recent Connecticut highway car crashes are being investigated for this reason. The most recent occured Saturday and involved numerous cars. A passenger in one of the vehicles suffered serious injuries and was taken by Lifestar to Hartford Hospital.

Connecticut laws have banned the use of hand-held devices (cell phones) for many drivers due to the high volume of car accidents they cause. If you or a loved one has been involved in a car accident, motorcycle accident or other motor vehicle accident caused by a distracted driver, contact our Hartford personal injury law firm for a free case analysis.
How To Avoid a Connecticut Pedestrian Accident

Recently Connecticut residents have been hearing tragic stories involving local pedestrians suffering serious injuries as a result of being struck by motor vehicles.
According to the Journal Inquierer, a local man was struck and killed by a motor vehicle as he was walking near the intersection of Main and Pearl streets Thursday January 5 2012.

WTNH reports on January 6, 2012, that a pedestrian was hit in Stamford and rushed to the emergency room. WFSB reports a similar story taking place in Manchester involving a young man and woman who were seriously injured when struck by a car while crossing Center Street. Our hearts and prayers go out to all of the people involved in these accidents.

Crossing the street seems like such a routine task. As pedestrians we assume that drivers can see us clearly and are looking out for us. As drivers, we assume that pedestrians will be overly cautious and remain still until we have passed. As this is not the case, it is important to review How to Avoid a Connecticut Pedestrian Accident.

For Drivers:

Avoid distractions. Looking down to dial a phone number, read a text or incoming email, or even glancing at the gps can mean the difference between life and death. It only takes a few seconds for a pedestrian to move from one side of the street to another.

Check your mirrors: Almost 10% of all serious pedestrian accidents nationwide occur while a driver is backing up, despite the slow rate of speed.

Use extra caution - when driving through busy intersections. Be aware of pedestrians on sidewalks and do not assume they see you if you are making a turn or proceeding through the intersection.

Know the weather. In Connecticut we have to be especially aware of freezing temperatures creating black ice resulting in the inability to stop for an oncoming pedestrian.

For Pedestrians:

A recent nation wide study revealed that 43% of all pedestrian vs. motor vehicle car crashes are actually the pedestrians fault!! If you are a walker keep the following guidelines in mind.

When crossing a street, use a crosswalk. If there is not a painted crosswalk, cross in the presence of visual cues such as stop lights or signs. Typically these areas will be better lit than other parts of the roadway.

Remain highly visible. Many Connecticut towns do not have sidewalks forcing pedestrians to walk on the road. Be sure to wear reflective clothing and "illuminate!" I found a great product at Fleet Feet in West Hartford mentioned
	here called knuckle lights.

These are great for getting the attention of on coming vehicles.
